PLEASE READ THESE TERMS AND CONDITIONS OF SALE CAREFULLY BECAUSE THEY CONTAIN IMPORTANT INFORMATION ABOUT YOUR RIGHTS AND OBLIGATIONS, AS WELL AS LIMITATIONS AND EXCLUSIONS THAT MAY APPLY TO YOU.
These Terms and Conditions of Sale apply to your purchase from us via this Web Site. You acknowledge that you are fully aware of the contents of these Terms and Conditions of Sale and, on placing any purchase order for any product, you agree to be bound by and accept these Terms and Conditions of Sale.
- The term “EduLib” or “us” or “we” refers to the owner of the Web Site:

- “Product(s)” refers to any Service or Software Product sold by EduLib on this Web Site;
- “Customer” means a person who orders Products via this Web Site.
These Terms and Conditions of Sale apply to all orders placed by the Customer with EduLib or its reseller by any means, including, but not limited to, electronic ordering via EduLib Web Site, by fax, by mail, or by e-mail.
All Software Products are provided to you under license; they are not sold.
Besides these Terms and Conditions of Sale, the Customer or end-user of Software Product will also need to agree with the End-User License Agreement (EULA) of the Software Product at the time of installation of Software Product. You can request a copy of the EULA of the Software Product you are interested in from EduLib (see Our Contacts).
This agreement and any sales hereunder shall be governed by the laws of the Romania, European Union. Any legal action or proceeding related to this agreement shall be instituted solely in a court in Romania. If any legal action is brought to enforce this agreement, the prevailing party will be entitled to receive its legal fees and costs.
Prices and Tax
All products are priced in USD and upon online payment a conversion to a local currency may occur.
All prices are subject to change without prior notice.
All prices are listed excluding any sales tax (VAT). According to EU regulations, independent of the seller’s location, all customers located within the EU are required to pay VAT. The final purchase price, including VAT, if any, will be available to the Customer prior to confirming the order. Should you have a valid VAT ID and be in a different EU country from the invoice issuer, you are exempt from VAT although as a EU taxable person you need to account for the VAT under the reverse charge (self-assessment) mechanism.
An order must be paid by either:
- Credit card (online). Online credit card payments are handled by the third party payment provider Avangate. A link to the Avangate secure servers can be found at the Order web pages on this Web Site. The Customer’s credit card details are collected and payments approved by Avangate. EduLib never sees or records Customer credit card details.
- Other offline and online payment methods such as Checks, PayPal, Purchase Orders, implemented by the third party payment provider Avangate.
- Bank wire transfer (all bank processing costs to be paid by the Customer).
You will receive all invoices by e-mail only.
Avangate Customer Support Center is available 24/7 and provides you with complete answers to questions about order, payment and product delivery processes.
Our Products are delivered via electronic download only. For instant payment methods like Credit Card or PayPal, the delivery information will be sent via e-mail, usually within a few minutes after an order has been successfully completed. For payment methods such as Bank Transfer, Check or PayPal, the delivery will be done after the payment is confirmed (usually 2 to 3 business days).
The delivery information consists in a Permanent License Key (File) along with the activation instructions which are sent by e-mail to the address mentioned by you at the time of order. You shall be responsible for ensuring the e-mail address provided is correct and that the spam filtering settings on your e-mail account do not reject our e-mails.
Refunds and Transfers
We provide a functional Free 30 Day Trial period to let you fully evaluate our Products before you make your purchase decision. The trial registration is fully functional, except slight limitations could apply depending on Product during an application instance (run).
All sales involving the delivery of a Permanent License Key (File) by e-mail, are considered final. In some instances but only within 30 days of purchase, if due to technical issues or platform incompatibilities the Product does not function, we will, at your request, issue a refund. This refund policy does not apply when the payment is done via Purchase Order.
By placing an order for any of our Products, you indicate that you have read this refund policy and that you agree with and fully accept the terms of this refund policy.
A software license may not be sold or rented out without EduLib’s written permission.
Warranties and Liability
To the fullest extent permitted by law, the Product sold by EduLib is provided as is and with no warranties of any kind, whether express or implied, including, without limitation, any warranty of merchantability or fitness for a particular purpose.
In no event shall EduLib, or anyone else who has been involved in the creation, production, or delivery of the Product be held liable whether in contract or tort (including negligence) or otherwise for any loss of profit, health, or any commercial damage, including, but not limited to, special, incidental, consequential, or other damages resulting from the use, or misuse of the Product.
To the extent permitted by law, the total liability of EduLib in all circumstances is limited to the price paid by the Customer for the relevant Product.
A more detailed description of the limitation of warranty and the limitation of liability of the Product is given in the EULA of the Product.
